Superior Court Judge Linda Feinberg will hear a motion for summary judgment tomorrow filed by a Tea Party group that wants to recall U.S. Senator Robert Menendez (D-Hoboken).  The recall committee filed a notice of intent with then-Secretary of State Nina Mitchell Wells on September 25, and filed a lawsuit two months later after Wells failed to respond.  Wells left office on January 19, and an attorney representing her successor, Lt. Gov. Kim Guadagno, will represent the state in court tomorrow.  Guadagno, like Wells, is expected to take the position that the U.S. Constitution does not provide for the recall of Senators and Congressmen, and that her office has no authority in the matter.  Even if the state were to allow the recall movement to advance, it’s unlikely that a vote will ever happen: to recall a statewide elected official, a committee would need to file a petition signed by an estimated 1,306,224 registered voters to get on the ballot.
