The Senate Judiciary is expected to consider Fox's nomination on Monday.
Governor Jon Corzine had renominated Fox, the wife of Democratic political consultant Steve DeMicco, last year. But then-Senate Judiciary Chairman John Adler, who was running for Congress, refused to consider Fox's nomination until a court ruled on a lawsuit filed by a whistleblower who alleged that Fox retaliated against him for exposing an unauthorized $83 million energy program account. The case was dismissed in January.
