As they consider the challenge of the Special Election Convention results for State Senator in the 37th district, one option for the New Jersey Judiciary is to simply punt. Article IV, Section IV, Paragraph Two of the State Constitution says: "Each house shall be the judge of elections, returns and qualifications of its own members." The 39 remaining Senators: some Corzine Democrats, some Ferriero Democrats, and eighteen Republicans, could make the call on who replaces Byron Baer in the Senate until the November Special Election -- if the Senate meets again.
