On September 15, 2005, Democratic County Committee members in the 37th District (Bergen County) held a Special Election Convention to fill the vacancy created by the resignation of Byron Baer (D-Englewood). The winner of the Special Election Convention will serve in the State Senate until the results of a November 2005 Special Election for the remaining 26 months of Baer's term are certified.
In a separate vote, Bergen County Democrats also held a Special Convention to nominate a candidate to run in the November 2005 Special Election.
Zisa had won the Special Election Convention 114-110 and the Special Convention nomination 112-111. Five unopened ballots from Tenafly were sealed on 9/15 and opened on 10/5 after a legal challenge. All five ballots were for Weinberg.
