If former Assemblyman Lou Manzo wants to throw Jerramiah Healy out of office, it looks like he might have to run against him next year.
Monmouth County Superior Court Judge Lawrence Lawson today said that Manzo had no standing to challenge the Monmouth County Prosecutor’s decision not to seek Healy’s forfeiture from office following his 2006 conviction for disorderly conduct in Bradley Beach.
“I am pleased that Judge Lawson dismissed Lou Manzo's frivolous case, which was clearly filed for political purposes," said Healy in a statement.
Healy indicated that he will also drop his own suit against Bradley Beach so that he can “move forward.”
Manzo is already getting to appeal the decision, saying that Healy was getting special treatment that average citizens and less powerful elected officials aren't entitled to.
“We looked at it, and my thoughts are number one.... to get thrown out of standing is unheard of, and secondly all the case law on anything involving forfeiture has always come down the court’s ruling. The statute must be interpreted to protect the public, not the employee. This judge actually did an about face and protected Jerramiah Healy, the employee,"he said.
