Assemblymen Joseph Vas, Upendra Chivikula, Jeff Van Drew

Under current law, an individual who takes a leave of absence from their job to fulfill their military obligation has certain protections that entitle that individual to return to the former office, position or employment they held when they left. The measure would expand those protections by requiring employers to offer a returning employee any position available, for which they are qualified, if the original position was filled in their absence.

"This measure ensures fairness in the workplace for individuals who are bravely serving our country", said Chivukula (D-Somerset). "They should not be penalized for fulfilling their duty."

"Our veterans shouldn't have to fight for a job they already earned," said Van Drew (D-Atlantic/Cape May/ Cumberland). "The residents of New Jersey should be proud of their dedication to our country."

The measure was part of an Assembly floor voting session that was targeted toward assisting veterans, military personnel, and their families. The 13-bill pro-military veteran's agenda included measures to expand civil service hiring preferences for veterans, provide extended military personnel tax exclusions on home sales, require the state to evaluate providing home health care aides for qualified veterans and create a new commission to provide better services for women veterans.

The bill passed 76 to 0. It now heads to the Senate for further consideration.
