RUMANA ON NJ SUPREME COURT DECISION TO HEAR COAH APPEAL

            Assembly Republican Deputy Conference Leader Scott Rumana, R-Passaic, Bergen and Essex, a long-time staunch opponent of the current burdensome COAH law and sponsor of legislation to abolish COAH, issued the statement below following today’s announcement that the New Jersey Supreme Court will hear the Appellate Division’s decision that invalidated COAH’s flawed Third Round regulations: 

            “Hopefully, the state’s highest court will not legislate from the bench on an issue that has very serious implications and consequences for our municipalities which have been strapped with unreasonable and unrealistic COAH mandates.

            “Claims by so-called affordable housing advocates that wealthy municipalities want to build walls that exclude working New Jerseyans, seniors, and people with special needs are completely unfounded.

            “The only walls the communities in the district I represent want built are flood walls thanks to the flooding that has been made worse due to mandated ‘affordable housing’ overdevelopment and flawed policies like bonus density. I urge these self—proclaimed advocates to come see how devastating their misguided policies have been in communities in the Passaic River Basin.

            “Many municipalities – like Wayne, Little Falls, Oakland, and Cedar Grove – do not have the open space to accommodate more development. Nor do they have the infrastructure. Mandated development promoted by COAH would strain their resources to their breaking points.

            “COAH is a failed policy that needs to be abolished now through responsible legislation, not judges who don’t understand the devastating effects these rules have had on so many communities.”
